Terms of Sale
These terms apply to all sales of tiles and related products by Mittsu Building Materials Trading L.L.C.
Payment
Payment terms are as stated on the quotation or invoice. Production, allocation, and shipment may not proceed until payment has been received in cleared funds.
Shipping Costs
Shipping and logistics costs are based on rates available at the date of the quotation or invoice.
Due to factors outside our control, including fuel costs, shipping routes, port access, and geopolitical events, these costs may change.
Where shipping or logistics costs increase by more than 25%, the increase will be passed on to the Buyer.
Delivery
Delivery dates are estimates only and are not guaranteed. Time for delivery is not of the essence.
We are not liable for delays caused by shipping disruption, port congestion, routing changes, or carrier issues.
Delivery is kerbside unless agreed otherwise. The Buyer is responsible for unloading and handling.
Natural Variation
Our tiles are produced using traditional ceramic processes. Variation in size, shade, texture, and finish is inherent and forms part of the character of the material.
These variations do not constitute a defect.
Inspection and Claims
Goods must be inspected on delivery.
Claims for damage or shortage must be submitted in writing with supporting images within 24 hours of delivery.
Claims for non-delivery must be submitted within 3 days of the expected delivery date.
Claims outside these timeframes will not be accepted.
Returns
We do not accept returns for unwanted, surplus, or incorrectly ordered goods.
Any return must be agreed in writing prior to dispatch and is at our discretion.
Cancellation
Orders cannot be cancelled without prior written agreement.
Approved cancellations may incur a minimum charge of 35% together with any costs incurred.
Liability
Our liability is limited to replacement of the goods or refund of the price paid.
We are not liable for indirect or consequential loss, including delay costs or loss of profit.
Governing Law
These terms are governed by the laws of the United Arab Emirates.
